STUART BERGER

Stuart is an Associate of the firm and was admitted to the New York Bar on January 25, 2006, New Jersey Bar on May 18,2006, the United States District Court for the District of New Jersey on June 1, 2006, United States Court of Appeals for the Third Circuit on July 11, 2008, the Bar of the Commonwealth of Pennsylvania on January 6, 2012, United States District Court for the Southern District of New York on May 15,2018, and United States District Court for the Eastern District of New York on May 29, 2018. Education: Seton Hall University School of Law (J.D. 2005), University of Pennsylvania (B.A. 2002).

Stuart has experience providing litigation and counsel to a wide variety of individuals and business entities. Prior to joining the firm, Stuart has more than 14 years of litigation experience including representing clients in all phases of litigation in a wide variety of matters from inception to conclusion of the suit as well as on appeals. He has handled matters spanning the spectrum of representing individuals and business entities in their pursuit of and/or defense from personal injury, defamation, collection actions, business disputes, as well as representing insurance carriers in insurance coverage disputes. Stuart also served as law clerk to the Honorable John A. Petersen, Jr. J.S.C.(ret.).

Among his litigation accomplishments, Stuart was on the successful appellate brief in Northfield Insurance Company v. Mt. Hawley Insurance Company, 454 N.J.Super. 135, 184 A.3d 517 (App.Div.2018), wherein the court held that an insurer could not, as a matter of law, be estopped from denying coverage where there was no clear evidence that a defunct insured’s position changed to its detriment, even if the insurer assumed the defense without the defunct insured’s consent, and the court also rejected argument that Merchants Indemnity Corp. v. Eggleston, 37 N.J. 114 (1962) permits avoidance of estoppel only if the insurer uses certain magic words in communicating with its insured. Stuart was also on the successful appellate brief in Lugo v. Marieco, LLC, 2012 WL 6115703 (A-1949-11T3)(App.Div. December 11, 2012), wherein the Appellate Division affirmed the denial of a used car dealer's application for counsel fees pursuant to R. 4:42-9(a)(6) because the car dealer's ambiguous business practice of "title jumping" was the cause which engendered the litigation.

JOSE ESCANO

Jose is an Associate of the firm and was admitted to the New York State Bar in April 2022. Education: Elisabeth Haub School of Law at Pace University (J.D. 2021), Ithaca College (B.A. in Legal Studies 2016).

Jose practices in the areas of asbestos litigation, products liability, mass tort, and general liability in the State Court of New York. Jose has experience representing corporate clients in all phases of litigation, including taking and defending depositions, drafting and arguing motions, expert retention, trial preparation, and appearing in court. Prior to joining the firm, Jose gained experience by working on mass torts and general liability litigation for one of the largest firms in New York.

STEPHANIE MCALEER

Stephanie McAleer: Stephanie is an Associate of the firm and was admitted to the State of New York Bar in 2002 and the Southern District of New York. Education: Utica College of Syracuse University (B.S. 1997) and New York Law School (J.D. 2001). She practices in the areas of asbestos litigation, products liability, mass tort and general liability in New York State Courts. Stephanie has experience in all phases of litigation including drafting and responding to discovery demands, attending depositions, drafting motions, trial preparation, appellate brief preparation and court appearances. Prior to joining the firm Stephanie worked for over fifteen years in civil litigation, family law and bankruptcy.

Jeannine Carandola

Jeannine Carandola is a senior litigation paralegal with over 25 years of defense legal work experience. She has extensive knowledge of the current legal practices and terminology as well as experience of providing support to lawyers and legal executives. For the past 17 years, she has worked on New York Asbestos Litigation and is the paralegal who handles and prepares all answers for our New York matters and then ensures that they are processed and filed with the appropriate New York City Courts. In addition, she is in charge of handling all New York Settlement Deals from inception to resolution. Her extensive experience in researching and organizing large amounts of legal documents keeps our legal team in-the-know of important details.

Mattea Kotun

Mattea graduated with a BA in 2001 from Monmouth University and received her Paralegal Certificate in 2002 from Ocean County College.  She has 19 years of experience in the legal field.  Mattea is a senior paralegal at the firm and the firm’s head billing coordinator. Mattea is a valuable member of our team.  She is experienced with all billing aspects of the firm as well as handles and supports the partners and associates on litigation matters pending in both New York State and New Jersey State Courts.

Jon Tomaszewski

Jon graduated from Marist College in 2020 and is currently employed at the firm as a paralegal assisting in all areas of the practice. Jon has extensive experience in criminal justice and assists the firm in all aspects of investigation of claims and development of company defenses. Jon is an energetic, detail oriented, and valuable addition to our team.
